A NEW provision in the Municipal Elections Act, as amended, (Sec. 76.(6)) permits candidates to use the higher amount of either the Estimate of Maximum Campaign Expenses OR the Final Maximum Campaign Expenses limit. Below is a summary of the two calculated amounts.

(Please note:  the last day to file Financial Statements is 2:00 p.m. on Friday, March 25th, 2011). 

A supplementary financial report was submitted by a candidate in accordance with the requirements of the Municipal Elections Act.  The supplementary filing date was September 30, 2011.  An elector may make an application for a Compliance Audit within 90 days of the supplementary filing date.  The 90 day period ends THURSDAY, DECEMBER 29, 2011, however, the municipal offices will be closed at 12:00 noon on December 24, 2011 and re-open on Monday January 2, 2012 at 8:30 a.m.

In accordance with the Legislation Act, applications for a Compliance Audit will be received during regular business hours on the first business day following the closure of the municipal offices being MONDAY, JANUARY 2, 2012.

Joint Compliance Audit Committee

JOINT COMPLIANCE AUDIT COMMITTEE
For The Towns of Aurora, East Gwillimbury, Georgina,
Richmond Hill and Whitchurch-Stouffville
and The Township of King

MANDATE

The Township of King and the Towns of Aurora, East Gwillimbury, Georgina, Richmond Hill and Whitchurch-Stouffville established a Joint Compliance Audit Committee (Committee) under Subsection 81.1 (2) of the Municipal Elections Act, 1996 (Act).  The Committee is charged with the following duties:

  1. Within 30 days of receipt of an application requesting a compliance audit, the Committee shall consider the compliance audit application and decide whether it should be granted or rejected;
  2. If the application is granted, the Committee shall appoint an auditor to conduct a compliance audit of the candidate’s election campaign finances;
  3. The Committee will review the auditor’s report within 10 days of receipt and shall decide whether legal proceedings should be commenced; and
  4. If the auditor’s report indicates that there were no apparent contraventions and if there appears there were no reasonable grounds for the application, the Committee shall advise Council accordingly.

A minimum of three (3) members of the Committee shall be called upon to hear an application.  The term of appointment for the Committee will expire on November 30th, 2014.  Click here to view the Committee’s Terms of Reference.

In accordance with Section 81.1 (4) of the Act, administrative practices and procedures for the Joint Compliance Audit Committee have been established.  Upon receipt of an application for a compliance audit, the Clerk of the applicable municipality, shall act as Secretary and shall carry out any other duties required under the Act to implement the Committee’s decisions.

Please note that the Committee will only consider matters related to candidates for Municipal Council (Mayor, Ward Councillor or Regional Council, if applicable) from the October 25, 2010 Municipal Election.  Please refer to the Links section to contact the Secretary of the applicable school board for information on the compliance audit application procedure for school board candidates in the October 25, 2010 Municipal Election.

 Application Procedure and Form

Should an eligible voter in King, Aurora, East Gwillimbury, Georgina, Richmond Hill or Whitchurch-Stouffville, who believes that there are reasonable grounds that a candidate for Municipal Council (Mayor, Regional Councillor, Ward Councillor) in the October 25, 2010 Municipal Election has contravened a provision of the Act relating to election campaign finances, may apply for a compliance audit of the candidate’s election campaign finances.

  1. The application must be made within ninety (90) days after the latest of the filing deadlines:
    • Regular campaign period filing deadline: 2 p.m. on Friday, March 25, 2011;
    • Supplementary campaign period filing deadline: 2 p.m. on September 30, 2011 (if applicable);
    • Another deadline as provided for in Subsection 79.1 of the Act (if applicable); or
    • The expiration of a filing extension pursuant to Subsection 80 (4), if any.
  2. Within 10 days of receiving the application, the Clerk shall forward the application to the Committee.
  3. Within 30 days of receipt of an application requesting a compliance audit, the Committee shall consider the compliance audit application and decide whether it should be granted or rejected.
  4. If the application is granted, the Committee shall appoint an auditor to conduct a compliance audit of the candidate’s election campaign finances.
  5. The Committee will review the auditor’s report within 10 days of receipt and decide whether legal proceedings should be commenced.

Appeal

Decisions of the Committee may be appealed to the Ontario Court of Justice within fifteen (15) days after the Committee’s decision. 

Cost Recovery

If the auditor’s report indicates that there were no apparent contraventions of the Act and if there appears there were no reasonable grounds for the application, Council is entitled to recover the auditor’s costs from the applicant.
